1. Introduction
Welcome to Optimum Health. These Terms of Service ("Terms") govern your use of our website, services, and facilities. By accessing our website or using our services, you agree to these Terms. Please read them carefully. If you do not agree with these Terms, please refrain from using our services.
2. Definitions
“Optimum Health” refers to the business providing wellness services including but not limited to: chiropractic, functional medicine, contrast therapy, PEMF, light therapy, and compression therapy.
“Services” refer to all services provided by Optimum Health, including recovery room services, chiropractic care, functional medicine, and any other treatments.
“You” or “Client” refers to any individual who accesses our website, visits our clinic, or uses our services.
3. Services Provided
Optimum Health offers a range of wellness services, including but not limited to:
Recovery room services such as contrast therapy (sauna and cold plunge), PEMF therapy, light therapy, and compression therapy.
Chiropractic care and functional medicine services.
All services are provided by licensed professionals where applicable and are designed to promote holistic health and wellness.
4. Eligibility
Minors (Under 18 Years Old): All minors must have a parent or guardian sign a waiver before using any services at Optimum Health. Minors under 16 years old must have a parent or guardian present in the clinic while receiving recovery room or provider care services. Minors aged 14-15 may use contrast therapy services with parental supervision, while PEMF therapy, light therapy, and compression therapy are available to individuals under 14 with appropriate consent.
Contrast therapy: You must be 14 or older to use contrast therapy in the clinic. All other recovery room services may be used with parental/guardian consent.
5. Appointments and Cancellations
Booking: Appointments can be made online, by phone, or in person. We recommend booking in advance to ensure availability. Walk-ins are welcome.
Cancellations (individual bookings): If you need to cancel or reschedule an appointment, please do so at least 12 hours in advance. Appointments canceled within 6 hours of visit will result in a $30 fee. If you fail to show up without notifying, you will be booked full charge for service. We will not extend the time if you show up late for a booked appointment, as it will alter our schedule for remaining guests. If you call and there is time available that day, we can re-schedule you with no charge.
Cancellations (members/packages): If you have a membership or purchased Services under a prepaid package and you are subject to paying a late cancel or no-show fee, you will not lose a credit in addition to paying the late cancel or no-show fee.
6. Memberships
Membership Terms: We offer Services to both Members and Guests. A “Member” is someone who purchases Services through a membership plan, while a “Guest” purchases Services outside of a membership plan, either as a walk-in or through a la carte or prepaid options. These Terms apply to both Members and Guests, although additional terms may apply to Members, as outlined below.
Cancelation: You must notify 30 days in advance of canceling your membership at the clinic. You may cancel online or in person. After you submit your cancellation notice, you will retain the right to use any remaining credits in your account until the end of your final billing cycle, typically within 30 days from the date the cancellation notice was provided. Any credits that remain unused at the expiration of your final billing cycle will be considered forfeited and lost. We do not issue refunds for unused credits.
Renewal: Memberships will automatically renew every month days unless properly canceled. Your membership is personal to you and cannot be transferred to another person without our prior approval.
Price: We reserve the right to increase the price for memberships annually. We will use reasonable efforts to provide you written notice of a membership price increase at least 30 days prior to any price increase taking effect.
7. Packages
Package Terms: Members and Guests have the option to purchase Services in prepaid packs, each containing a set number of credits that can be redeemed for Services. Unless specified otherwise, one credit is typically used for a single session of Services. All credits in the pack are yours from the date of purchase. These packs are non-transferable and cannot be given to someone else without our explicit permission. Once purchased, prepaid packs are non-refundable. Credits can only be used at the Optimum Health location where they were bought. All credits must be used within 12 months of purchase; any unused credits after this period will be forfeited, and no refunds will be provided.
8. Payments
Payment Terms: Payment is due at the time of service unless other arrangements have been made. We accept major credit cards, debit cards, and other approved payment methods.
Refunds: All sales are final. Refunds will not be provided for any used services or missed appointments.
9. Discounts
Discount Policy: Optimum Health offers a variety of discounts on services at our facility. However, discounts cannot be combined. You must choose one discount for which you are eligible per transaction or service. Please inform us of the discount you wish to apply at the time of payment.
10. GIFT CARDS
Gift cards are available for purchase and come with their own terms and conditions. Services purchased via gift cards are subject to these Terms.
11. Health and Safety
Medical Clearance: Some services may require medical clearance from a healthcare provider, especially for clients with pre-existing conditions. Please inform us of any health issues or medications you are taking before receiving treatment.
Client Responsibility: You are responsible for informing us of any changes to your health status before receiving services.
12. Right to deny services
We reserve the right to deny Services, terminate a membership, or restrict (or completely bar) access to any Pause Studio location for any reason not expressly prohibited by law.
13. Privacy and Data Protection
Confidentiality: We respect your privacy and are committed to protecting your personal information. We collect and use your data in accordance with our Privacy Policy. We use HIPAA compliant software in the clinic and won’t release medical records unless requested and you fill out a release form.
Data Use: Your information will be used only for providing services, managing appointments, and communicating with you about our offerings. We will not share your information with third parties without your consent, except as required by law.
14. Liability and Disclaimers
Informed Consent: By using our services, you acknowledge and accept the risks associated with wellness treatments, including any potential adverse effects. You agree that Optimum Health shall not be held liable for any injuries or conditions that may arise as a result of your use of our services, except in cases of gross negligence or willful misconduct.
No Guarantees: While our services are designed to promote health and wellness, individual results may vary. We do not guarantee specific outcomes from our treatments.
15. Changes to Terms
Optimum Health reserves the right to update or modify these Terms at any time. Any changes will be posted on our website, and your continued use of our services constitutes acceptance of the revised Terms.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Minnesota.
